General Conditions of Sale and Use of Viadeo |
Introduction |
By becoming a member of Viadeo, you agree to comply with the present conditions of use. If you do not accept these general conditions of sale, you must not register with Viadeo. Subscription to one or several services together with the use of the present site implies full and complete acceptance by the member of the present conditions.
Article 1 - Joining Viadeo |
To be a member of Viadeo, you must be an adult and fill in all the mandatory fields on the registration forms.
Equipment (computer, software, means of telecommunication, etc.) used to access Viadeo services are under your exclusive responsibility, as are the telecommunication costs incurred by their use.
You guarantee that the data you share with us is accurate and true. You agree to provide a real email address, of which you are the actual owner. You waive any claim and/or legal action against Viadeo if you do not to receive service messages from Viadeo sent by email to the address you have provided.
Once registered, you will be given one or several personal and confidential login(s) and password(s). These must not be communicated to or shared with third parties. In no case will Viadeo be held responsible for the loss of your usernames and/or passwords.
In the event that you misuse the login and authentication logins/passwords, Viadeo reserves the right to terminate your account without prior notice. You will be solely liable for the use of the login and authentication logins/passwords by third parties or for actions or statements made through your account, whether fraudulent or not. You hereby agree indemnify Viadeo against any claim, fine or damages resulting from such misuse.
Viadeo does not have the means to check the identity of people registering for its services. Viadeo will not be held responsible for any alleged or actual identity theft. If you think that someone is using your account or your identity, you must inform us immediately by post at the aforementioned address.
When a member wishing to invite a contact provides Viadeo with their email address, he warrants having received this friend's prior consent (actual or implied) authorizing their data to be used by Viadeo. It is solely responsible for the consequences of the transmission to Viadeo of the coordinates of their contact(s).
Viadeo reserves the right to deactivate the accounts of members who have not connected to the service for a period of 6 (six) months or more.
In accordance with relevant distant selling legislation, you are informed that you are entitled to a period of seven calendar days, from the date of subscription, to exercise your right of withdrawal without penalty and without cause. However, the right of withdrawal may no longer be exercised once you have accessed the features associated with this service.
Article 2 - Use of Viadeo |
Once registered, you will be granted access to Viadeo's services. The price and payment terms and conditions for the different services are available on the Viadeo site during introduction to and use of the services you wish to subscribe for.
By using Viadeo, you specifically agree to observe the following rules:
- To comply with the applicable laws in force and to respect the rights of third parties as well as the present provisions.
- To deal in good faith with Viadeo and other users.
- To respect the intellectual property of Viadeo, other users and third parties.
- To use Viadeo features only for their intended purpose.
- Not to overload the Viadeo service. Specifically, not to download more than 1,000 Viadeo pages per day without our written consent.
- Not to send Viadeo or other users any data your private information which if disclosed could be prejudicial to you.
- Not to distribute data or contents that are untrue or misleading.
- Not to distribute or post any data or contents that may harm other users or third parties, or violate the rights of others, including but not limited to any content of a defamatory, insulting, obscene, offensive, violent nature or capable of inciting others to violence, nor content of a political, racist or xenophobic nature, or any other content that is contrary to the purpose of Viadeo, or any applicable laws and regulations.
- Not to distribute data or contents the effect of which is to diminish, disorganize, prevent the normal use of Viadeo, disrupting and/or slowing down the normal circulation of communications between members.
- Not to post ads or job offers in the Forums and Announcements. If you wish to post a job offer, The Career Area is reserved for this purpose.
- Not to take part directly or indirectly in a network designed to implement practices comparable to "pyramid selling".
- Not to take part, directly or indirectly, in the implementation or in the development of a network designed to implement practices comparable to multilevel marketing (MLM) network-based sales. Moreover, the recruiting of independent door-to-door salespersons (IDS) for the purpose of creating such a network or other similar practices is prohibited.
In case of infringement by a member of one or more of these rules, Viadeo reserves the right to terminate the contract unilaterally and without prior notification, to block the account(s) of the members in question, to automatically delete litigious messages, to prevent the posting of all or part of a member's profile, and/or to block their access to all or part of the services, on a temporary or permanent basis, without any compensation. In any case, no reimbursement of sums paid by the user shall be made following the permanent deletion of an account by Viadeo.
Viadeo shall not be held responsible for any false or misleading statements made by a member. Viadeo disclaims all responsibility related to any communications between Viadeo members, on Viadeo or during meetings between members and/or non members, as a result of the use of its site and services.
Article 3 - Advertisers Space/Lead Space |
The Viadeo site respects your right to privacy and has completed the relevant Data Protection registrations required in the United Kingdom.
Viadeo shall have the sole authority to decide whether to allow or remove content if a campaign does not respect the above principles. Viadeo shall have no liability in respect to any such action or inaction.
The data liable to be collected on Viadeo is exclusively intended to help you enhance your professional network.
Aticle 4 - Data Confidentiality |
The Viadeo site respects your right to privacy and has complied with the relevant Data Protection registrations in the United Kingdom.
Users may make certain information or contents (including but not limited to photos and videos) available on the website. The member is wholly responsible for all such information and contents, including any decision to disclose personal information including but not limited their ethnic origin, nationality and/or religion. By providing such data on the website, the user concerned demonstrates their explicit wish and, consequently, consent to the processing of this 'sensitive' data by Viadeo and freely accepts exclusive responsibility for doing so.
The data that may be stored on Viadeo is exclusively intended to help you build your professional network.
You have a right of access, rectification and deletion of your data under European Law. You can exercise this right by writing to the customer service department at the following address:

Article 5 - Intellectual Property |
The trademarks, logos, graphics, photographs, animations, videos and texts included on the Viadeo Website are the intellectual property of Viadeo or its partners and may not be reproduced, used or represented by third parties without the express authorization of Viadeo or they will be prosecuted.
Usage rights are only granted by Viadeo under digital format on your computer for the purpose of viewing the pages accessed by your browser. Hard copy printing is authorized for exclusive private purposes. Any other use is prohibited without the prior consent of Viadeo.
You are specifically prohibited from modifying, copying, reproducing, downloading, distributing, transmitting, commercially exploiting and/or distributing in any manner whatsoever the services, pages from the www.viadeo.com website or the computer codes of the items making up the services and the www.viadeo.com site.
Viadeo is licensed to use the intellectual property rights associated with the content provided by members for the purpose of communication on the www.viadeo.com site. This license specifically grants Viadeo the right to reproduce, represent, adapt, translate, digitize, use for advertising, commercial or non commercial purposes, to sub-license or surrender any of your content (information, description, etc.).
You expressly authorize Viadeo to modify the aforementioned content to respect the graphic appearance of the www.viadeo.com site or other communications media cited above and/or make it compatible with its technical performance requirements or the formats of related media.
Article 6 - Period of Subscription - Terminating your Account |
At the end of your subscription, your Premium membership will be renewed automatically for the same period.
You can stop any time your automatic Premium membership renewal, by clicking on 'Membership' and the following the steps below:
Click 'Home' then 'Membership' then 'status' for your membership details
Click 'Cancel' at the bottom of the page
Enter your password to cancel your automatic Premium membership renewal
Follow the five steps to delete your Viadeo account at any time without having to provide any notice.
1. Connect onto the site and insert your email address to log on.
Click on 'My profile'
3. Select 'My Account'.
4. Click on 'Delete my account' next to 'I would like to delete my Viadeo account'.
5. Confirm to delete your profile.
The deletion of you account and of your personnel details will be effective within 24 hours. As a result of this, you will not be entitled to a refund for the remainder of your subscription.
Your data will not be passed to third parties.
In the event of a breach on your part of the present terms of use, Viadeo reserves the right to suspend or terminate your account without notification or compensation.
This termination shall occur without prejudice to all damages and interests that may be claimed against you by Viadeo or its assignees and legal representatives as remedy for any damages incurred as a result of such failures.
Article 7 - Liability |
The information provided by a member must be accurate and true. The consequences of its disclosure on your life and/or on that of other members are your exclusive responsibility. You waive the right to any legal action against Viadeo, and specifically on the basis of potential damage to your right of personal portrayal, to your honour, to the intimacy of your private life, resulting from the distribution or disclosure of any of your information.
Viadeo cannot be held liable for the accuracy or inaccuracy of information and content provided by other members, visitors to the site and/or yourself. Likewise, Viadeo cannot be held responsible for content distributed by a member that may infringe the rights of one or several other members.
The quality of the www.viadeo.com site required by both Viadeo and its members implies compliance with a certain code of ethics in the expression and behavior of its members, the respect for the rights of third parties, as well as the respect of the laws and regulations in force. In order to meet the requirements of quality, individual and ethical responsibility, each member may notify Viadeo on the www.viadeo.com site of any data (picture, text), behavior or words of another member which they believe infringe on laws and regulations in force, or harm the image or purpose of Viadeo, the rights of third parties or morality. Consequently, members acknowledge and accept that the data they provide, as well as their behavior or their words are subject to notification by other members and to review and/or verification by Viadeo, on the basis of objective criteria of evaluation. In the event that this notification or verification reveal the violation by a member of any laws or regulations in effect or of the member's contractual obligations, the provisions of the current Terms of Use, and specifically Article 5 - "Termination of your account" may be enforced.
In the event that the responsibility of Viadeo is alleged due to failure by a member to meet their obligations under the terms of the law or under the current terms of use, the aformentionned member promises not to hold Viadeo responsible for any judgment against their, this guarantee covering both fines that might be paid as well as attorney's fees and legal costs the member may have to pay.
Article 8 - Viadeo's operation |
You must possess the skills, hardware and software required for Internet use and acknowledge that the features and limitations of the Internet do not make it possible to guarantee the security, availability and integrity of Internet data transmissions.
Viadeo does not guarantee that the services will function without any interruption or error. Specifically, their operation may be momentarily interrupted for reasons of maintenance, update or technical improvement, or for the upgrade their content and/or presentation.
Where possible, Viadeo shall inform its members ahead of time of any maintenance or update operation. You waive the right to hold Viadeo responsible for the operation and exploitation of the www.viadeo.com site.
Likewise, Viadeo will not be held responsible in the event of failure, access denial, or poor conditions of use of the Viadeo site due to inadequate equipment, to interruptions attributable to the member's access provider, to Internet network congestion, and/or any other reason out of Viadeo's control.
Viadeo shall have no liability in whole or in part for indirect losses including, but not limited to, loss of data (including copies) or back-ups that you could have made.
Article 9 - Modifications by Viadeo |
Viadeo reserves the right at any time to change or modify the pages of its website, the services, prices and/or conditions of use applicable thereto.
These modifications shall become effective as soon as they are put online on the www.viadeo.com site and will not constitute a cause for termination by a member of their Viadeo subscription.
Failing that, you shall be deemed to have accepted these modifications by continuing to use the www.viadeo.com site. Members are therefore invited to view the most recent online version on the site. A member's presence on the site implies their full acceptance of any revision or modification of the www.viadeo.com site.
Article 10 - Applicable law - choice of jurisdiction |
These terms and conditions are governed, interpreted and applied according to French law, and the version in the French language will be used in the case of any dispute or claim arising from the meaning of any term or these terms and conditions of sale and use. Subject to applicable law, the courts of the place of the registered office of Viadeo shall have exclusive jurisdiction for any claim or dispute arising from these terms and conditions including, but not limited to, their intrepretation, validity, execution, termination and/or the consequences thereof.
